1.6.0rc1 doesnt *appear* to have it included ?

The file is not included since it is created by the XMLSitemap plugin. That, however, requires write access for the webserver to the public_html directory.

All files are in the /httpdocs/ - I did not upload the /public_html/ folder as its own directory but copied the files into /httpdocs/ otherwise GL security checks informs me its dangerous to have puiblic_html in the url.

How should I proceed?

Replace "public_html" with "httpdocs" in my above post. In other words, make "httpdocs" writable.
