Staticpages Bug?!?

The staticpage I created to appear under featured story appears above and below it when $_CONF['showfirstasfeatured'] is set to 1, and I don't have an actual story set to featured. If I set the article is set to featured it shows up just underneath it.

I set the $_CONF['showfirstasfeatured'] to 0 until someone who knows the code a little better can have a gander at it.
